Killlaloe Boat Rental: Terms & Conditions for Vessel Hire

Eligibility for Rental

To be eligible to hire a vessel from Killlaloe Boat Rental, the Hirer must:
  • Be 25 years of age or older at the time of booking and collection.
  • Possess a valid driving license for a minimum period of five (5) years.

Clause 1 – Agreement to Hire

Killlaloe Boat Rental (referred to as "the Company") agrees to provide the Vessel to the Hirer on the specific date and at the confirmed time as detailed in the booking confirmation email issued to the Hirer. The Company retains the exclusive right to refuse any hire at its sole discretion, without providing specific reasons.

Clause 2 – Vessel Delivery Condition

At the commencement of the Hire Period, the Company undertakes to ensure the Vessel is delivered to the Hirer in good and serviceable condition, fully equipped as specified in the Company's operational standards and as generally outlined in Clause 9 of these Terms, and is ready for immediate use.

Clause 3 – Delays in Vessel Availability

Should a delay in the availability of the Vessel for hire exceed 25% of the total agreed Hire Period, the Hirer shall have the option to terminate this Hire Agreement. In such an event, the Company shall issue a full refund of all sums paid by the Hirer. For the avoidance of doubt, the Company shall not be liable to the Hirer for any other form of compensation, including but not limited to loss or damage of any nature, resulting from the curtailment or cancellation of this Agreement under this Clause.

Clause 4 – Payment and Security Deposit

The Hirer irrevocably agrees to hire the Vessel and undertakes to pay the stipulated Hire Fee and any other agreed charges via credit or debit card on the day the booking is made. A security deposit, the details of which will be communicated at the time of booking, may also be required and will be processed accordingly.

Clause 5 – Fines, Charges, and Financial Penalties

The Hirer acknowledges and expressly agrees to be liable for the payment of the following fines, charges, and financial penalties. The Hirer further authorizes the Company to charge their provided credit/debit card to cover any shortfall arising from these liabilities:
  • a) Navigation Limit Breach: A charge of €500.00 per incident if the Company is notified of any breach of the designated limit of navigation, as detailed in Clause 10.
  • b) Propeller/Underwater Gear Damage: A minimum charge of €75.00 for any damage caused to the propeller or underwater running gear. The Hirer assumes full responsibility for any such damage. It is strongly advised that the Hirer verifies the condition of the propeller and underwater running gear prior to departure.
  • c) Killlaloe Marina Speeding: A charge of €50.00 for exceeding speed limits within Killlaloe Marina, where the Hirer’s speed is officially logged or reported, resulting in a subsequent fine, as referenced in Clause 9.
  • d) Excessive Cleaning: A €25.00 cleaning charge if the Vessel is returned in a condition that the Company, at its sole discretion, deems unreasonably dirty, as further referenced in Clause 13.
  • e) Restricted Speed Area Violation: A fine of up to €1,000.00, payable to the relevant administrative authority, if the Vessel exceeds speed limits in designated restricted speed areas, as detailed in Clause 9.
  • f) Delayed Re-delivery: A charge of €25.00 for every fifteen (15) minutes of delay in re-delivery beyond the agreed time, particularly if such delay impacts the subsequent hirer, as detailed in Clause 14.
  • h) Vessel Damage Contribution: A maximum contribution of €1,000.00 towards the cost of repair in the event of damage to the Vessel, its engine, or other equipment sustained during the Hire Period. However, if it is determined that the damage has been caused by intentional, reckless, or negligent behaviour on the part of the Hirer or their guests, the Hirer shall be liable for the full cost of repair.

Clause 6 – Cancellation Policy & No-Shows

  • Hirer Cancellation: If the Hirer wishes to cancel this Agreement, they must provide notification to the Company by PHONE CALL ONLY to +35361294468 a minimum of 48 hours prior to the scheduled commencement of the Hire Period (referred to as “the Cancellation Window”). Provided this condition is met, the Company will treat the booking as cancelled, and a full refund will be issued. If the Hirer fails to cancel this Agreement within the Cancellation Window and subsequently fails to arrive for the commencement of the Hire, the Hirer agrees to forfeit all booking charges.
  • Company Cancellation (Weather): In the event that a booking is cancelled by the Company due to unfavourable weather conditions deemed unsafe for operation, a full refund will be made to the Hirer.

Clause 7 – Maximum Occupancy and Hirer Responsibility

The maximum number of persons permitted on board the Vessel at any time, irrespective of age or size, or the maximum total weight, shall not be exceeded. These limits are:
  • Sport boat (475S): 4 persons
  • Leisure boat (470): 5 persons
  • Maximum Total Weight: 450 Kg
Should children be on board, the Hirer assumes full and undivided responsibility for their safety, conduct, and entertainment throughout the Hire Period. The Company explicitly disclaims responsibility for the safety of children on board. The Hirer acknowledges that the nature of power-boating may render it unsuitable for individuals with certain physical disabilities, medical conditions, or those undergoing medical treatment. Hirers are strongly encouraged to contact Killlaloe Boat Rental to discuss any concerns regarding suitability prior to booking. By signing the Hire Agreement, the Hirer warrants the medical fitness of all crew members accompanying them on the Vessel.

Clause 8 – Skipper Responsibilities, Alcohol Consumption & On-board Behaviour

The Hirer, and any other person(s) designated as Skipper, must strictly comply with all relevant Active Life Bye-laws and regulations. These regulations explicitly state that boaters can be prosecuted if found to be under the influence of alcohol or illegal drugs while in charge of a Vessel. The Hirer, by assuming the role of Skipper, legally assumes full responsibility for the Vessel and all passengers on board. The designated Skipper must be at least 18 years of age and is required to remain completely sober for the entire duration of the Hire Period. Valid identification may be required to verify the Skipper's age.
While Killlaloe Boat Rental permits the consumption of alcohol on its vessels, strict limits are enforced to ensure a safe and enjoyable experience for all. These limits are:
  • Option 1: A maximum of two (2) bottles or cans per person of standard strength beer, lager, or pre-mixed spirits.
  • Option 2: A maximum of one (1) 750 ml bottle of wine, champagne, or prosecco between every two (2) people.
  • Strictly NO neat spirits are permitted on board.
Killlaloe Boat Rental reserves the absolute right to refuse access to the vessels, leading to the forfeiture of booking fees, if the Hirer or any member of their crew is deemed to be showing signs of excessive alcohol consumption (at the Company's sole discretion) prior to the commencement of the Hire Period.
Any reports of anti-social behaviour will be treated with utmost seriousness and will not be tolerated. Such behaviour will result in the immediate termination of the Hire Period without refund. Furthermore, the Company reserves the right to impose a fine of €25.00 for each instance of anti-social behaviour, which includes, but is not limited to, the following:
  • The designated Skipper being observed consuming alcohol.
  • The vessel being returned in an excessively dirty condition.
  • Beaching the boat: The Hirer must anchor the vessel at a minimum distance of 0.6 meters (0.6m>) from any shore to avoid potential engine damage. Taking the boat ashore is explicitly not permitted at any time.
  • Urinating in public.
  • Failure to maintain a safe distance from other vessels.
  • Any other behaviour deemed anti-social at the sole discretion of Killlaloe Boat Rental staff.
  • Littering: Rubbish must not be thrown into the water or left on any beaches. All rubbish must be retained by the Hirer and disposed of appropriately on return.
  • Repeated complaints of noise nuisance.


Clause 9 – Responsible Use of Vessel

The Hirer (the individual renting the vessel) shall, at all times, operate the vessel with due care and attention, maintaining a safe and prudent distance from all other vessels, persons, and objects on the water. The vessel is provided solely for pleasure purposes or as a means of personal water transport for the Hirer and their invited guests. Under no circumstances shall the vessel be used for racing, speed testing, intentional beaching, or commercial ferry services.
The Hirer bears full responsibility for ensuring that their conduct and the conduct of their guests do not cause a nuisance to any third party, or bring Killlaloe Boat Rental or the vessel into disrepute. The Hirer shall exercise utmost care and assume complete responsibility for the safety, security, and ongoing maintenance of the vessel and all its provided equipment throughout the hire period. The vessel must never be left unattended.
The Hirer undertakes to comply with, and ensure that all guests comply with, all applicable laws, bylaws, and regulations governing navigation and water use in Ireland for the duration of this Agreement. Strict adherence to speed limits in restricted areas is mandatory. Information regarding restricted speed areas, including but not limited to those referenced in specific marine notices, can be found via official sources such as Waterways Ireland (e.g., https://www.waterwaysireland.org/news-centre/marine-notices/611/special-marine-notice-no-1-of-2017). The Hirer is expressly prohibited from allowing any person not explicitly named on the Hire Agreement to board or operate the vessel.
It is the Hirer's paramount responsibility to ensure that all provided safety equipment, particularly life jackets, are correctly worn at all times by all persons on board. Guidance on the proper use of safety equipment will be provided by Killlaloe Boat Rental staff upon collection of the vessel.

Clause 10 – Permitted Cruising Area

The Hirer is strictly restricted to operating the vessel within Killaloe Harbour. The "limit of navigation" for all vessels hired from Killlaloe Boat Rental is clearly marked by designated navigational aids or a specific path. Any deviation beyond this defined limit constitutes a breach of this Agreement. Killlaloe Boat Rental vessels are equipped with systems to monitor compliance with these navigational limits. Financial penalties, as detailed in Clause 5a of the full Hire Agreement, will be rigorously applied for any such breaches.

Clause 11 – Prohibited Water Sports Activities

For the safety of all parties and to preserve the condition of our vessels, Killlaloe Boat Rental expressly prohibits the use of any water sports equipment including, but not limited to, ringos, wakeboards, water skis, or similar towable devices, in conjunction with our vessels.

Clause 12 – Breakdown or Disablement of Vessel

Should the vessel become disabled by a machinery breakdown after delivery, preventing its reasonable use, and provided such disablement is not a result of any act, omission, or default of the Hirer, Killlaloe Boat Rental shall refund €25 for every hour of lost use. To invoke this clause, the Hirer must provide immediate notification to Killlaloe Boat Rental upon the occurrence of the disablement. If the loss of use or disablement occurs within the first hour of the hire period, the entire Hire Fee shall be repaid in full by Killlaloe Boat Rental. For the avoidance of doubt, any grounding or beaching of the vessel by the Hirer is unequivocally considered an "act or default of the Hirer," thereby precluding any refund under this clause.

Clause 13 – Re-delivery Obligations

Upon conclusion of the hire period, the Hirer shall re-deliver the vessel to the designated area specified by Killlaloe Boat Rental. The vessel must be returned free of any outstanding debts incurred during the hire period and in a condition equivalent to that at the time of delivery, accounting only for fair wear and tear arising from ordinary, responsible use.

Clause 14 – Penalties for Delayed Re-delivery

In the event that the Hirer fails to re-deliver the vessel at the agreed-upon time and location, a penalty of €25 shall be payable for every fifteen (15) minute increment of delay (as further detailed in Clause 5f of the full Hire Agreement). The Hirer's obligations under this Agreement, including full responsibility for the vessel, shall continue unabated until its eventual re-delivery to Killlaloe Boat Rental.

Clause 15 – Non-assignment and Control

The Hirer shall not assign this Agreement, sub-let the vessel, or relinquish control of the vessel to any third party without the express prior written consent of Killlaloe Boat Rental. Any such unauthorized action shall constitute a material breach of this Agreement.

Clause 16 – Insurance and Liability

Killlaloe Boat Rental assumes no liability whatsoever for any loss, damage, or theft of personal effects, property, or equipment belonging to the Hirer or their guests. The Hirer is strongly advised to procure any additional personal insurance they deem necessary to cover such contingencies. It is important to note that cancellation and curtailment insurance are not included within the scope of this Hire Agreement.

Clause 17 – Dispute Resolution and Governing Law

Any dispute arising in connection with the interpretation or fulfillment of this Agreement shall first be referred to a mutually agreed upon relevant responsible authority for mediation or resolution. If the dispute remains unresolved following such referral, it shall ultimately be settled by the competent courts. This Agreement shall be construed and governed in accordance with the laws of the Republic of Ireland.
